BOI: Changes in the E-commerce Sector

In September, the Thailand Board of Investment (BOI) consolidated three business activities — software, e-commerce, and digital services — into a single category: “Software development, digital service platforms, or digital content” (5.10).

Incentives under the new category

The benefits include:

– Corporate income tax exemption for up to 8 years
– Import duty exemption on machinery
– Full package of non-tax incentives

A unified incentive category A2 now applies. Previously, these activities fell under different categories (B2, A3, and A1) with varying levels of benefits.

Additionally, projects in this category are now allowed to use second-hand equipment.

Project requirements to obtain BOI certification

– Annual salary expenses for Thai IT personnel must be at least 1.5 million THB
(Previously, this included combined salaries of Thai and foreign IT staff)

– Core activities related to software development, digital platforms, or digital content must be carried out within Thailand

Important limitations

– Projects under this category are not eligible for additional SME investment incentives

– Revenue must be generated from activities directly related to:
– Software
– Digital service platforms
– Digital content

Wholesale and retail trading activities are not included in this category
