Title Documents for Land in Thailand

If we are speaking about a condominium unit, there is only one title document, which is the Chanote.

If we are speaking about a land plot, several options are possible. In Thailand, there are approximately 20 types of land title documents. However, the most reliable and preferred option remains the Chanote. Another acceptable option is the Nor Sor 3 document, on the basis of which a Chanote may later be obtained without significant difficulty.

Chanote and Nor Sor 3: What is the difference.

The Chanote defines the exact boundaries of the land plot using GPS measurements and is officially approved by the Land Department. This minimizes disputes and makes the land legally secure.

Nor Sor 3 is a less precise document. The stated area may not correspond to the actual size of the land, and before beginning construction, for example of a fence, consent from neighboring owners regarding boundaries may be required.

It is important to understand that a Chanote confirms ownership of the land only and does not contain information regarding buildings or structures located on the plot.

How to verify the authenticity of a Chanote.

The boundaries of land stated in a Chanote are marked by special concrete boundary markers bearing Land Department seals and the Chanote number.

To verify the information:

  • compare the inscriptions on the markers with the details stated in the Chanote.
  • make sure the markers have not been moved without authority.
  • engage a cadastral surveyor if there are any doubts regarding the location.

Legally, the land remains in the position recorded in the Chanote regardless of any physical manipulation of boundary markers. For this reason, it is essential to conduct legal and technical due diligence before entering into a transaction.

Why should documents be checked before purchase.

Reviewing a Chanote for:

  • correct boundaries.
  • existing encumbrances.
  • construction permissions and restrictions.

costs disproportionately less than the price of the land itself.

However, such verification is what provides peace of mind and legal protection after registration of ownership rights.
